§ 24-30. Unlawful activities.

  • (a)

    It shall be unlawful for anyone to intentionally by any means or device prevent water or gas from passing through any meter belonging to the city or to register the amount of water or gas passing through meters or to intentionally prevent a meter from duly registering the quantity of water or gas supplied.

    (b)

    It shall be unlawful for anyone to interfere in any way with the proper action or just registration or, without the consent of the manager or superintendent of the city utilities, to intentionally divert any water or gas from any pipe or pipes of the city.

    (c)

    It shall be unlawful to intentionally use or cause to be used, without the consent of the city, any water or gas produced or distributed by the city with the intent to defraud.

    (d)

    The discovery of an unauthorized use under this subsection shall be prima facie evidence that such use was installed by or maintained by the person or entity that city records show as receiving such service. Also, after a utility service has been turned off by the city, discovery that the utility meter valve has been turned on without authorization shall be prima facie evidence that the person or entity that the city records show as receiving such service, turned on such utility meter valve.
